There are many different tools that one can use to make sure their assets are distributed according to their will when the time comes. If these tools are not implemented correctly, then it may be up to the court and the judge where your property goes. Make sure all your affairs are in order in compliance with Georgia state law and get rid of the worry that your assets will not go to your loved ones when you pass.
A Will is designed to help protect your loved ones and your assets. It can also help to name a "personal guardian" who can look after your children under 18 and look after the property meant for your young children until they come of age. A Will must also name an "executor," who is designated to ensure the wishes of the Will are achieved.
A Power of Attorney is a legalized document that nominates an individual to be your "Agent" and gives them the legal ability to make choices in regards to your property on your behalf if you are not in a position to be able to make those decisions yourself.
A health care directive gives you the ability to designate, in legal writing, your health care needs and wishes in the unfortunate event that you lose the mental state to be able to provide consent.
